The mark was first used in commerce in a different form other than that sought to be registered at least as early as 09/14/2009;The mark consists of stylized wording DIPPY CUPS with the term DIPPY centered above the term CUPS. Above the PPY portion of the term DIPPY is a serving cup, which is shaded and outlined. Inside the cup is a soft condiment indicated by a swirl. Dipped in the condiment is a strawberry with a smiling face having solid eyes and an outline of a slightly open mouth. The strawberry has solid seeds on its body as well as leaves at its crown.
