Applicant seeks concurrent registration for the mark in accordance with the Final Order for Concurrent Use and Registration entered on August 9, 1999, in the United States District Court for the Western District of Oklahoma in the case styled Central National Bank & Trust Company, of Enid, plaintiff and Counter Defendant, vs. Central National Bank of Alva, Defendant and Counter Plaintiff, vs. Mick Thompson, in his capacity as Commissioner of the Oklahoma Banking Department, Nominal Counterclaim Defendant, assigned case number CIV-98-0472 T. The Final Order provides in part that Applicant will: (1) have the exclusive right to use the mark in the geographic area lying within a 30 mile radius of the city hall of Alva, Oklahoma; (2) have no right to use the mark within a 30 mile radius of the city hall of Enid; and (3) have the right to use the mark concurrently with CNB-Enid outside these two areas, if combined with the city name Alva.
