The mark consists of a dark shaded oval that gradually fades at its border from the interior darker shade to a lighter shade at its exterior, and diagonally over top of the oval is the word TOPAZ written in large, lighter-colored capital letters that have a 3-D appearance, and the O of TOPAZ appears in the design of a topaz gemstone with pointed triangles radiating out from the stone as if it is dazzling, and the stem of the P of TOPAZ extends much lower than the other letters such that it ends almost outside the oval, and the top right corner of the Z of TOPAZ lands outside the oval, and below the A and Z of TOPAZ written in the same diagonal way is the word APPLES in smaller and light-shaded capital letters that are plain and have no 3-D appearance.;Color is not claimed as a feature of the mark.;Fresh fruit; Fruits, namely, fresh apples and fresh cherries; Fresh apples;
